Malaysia's Opposition,which failed to topple Prime Minister Najib Razak's Umno-BN government in an election marred by fraud accusations and millions of complaints of indelible ink that could be washed off within the hour, will launch a two-pronged legal offensive to reclaim a victory they say was "stolen" from them.
Apart from election petitions to be filed in about 20-odd constituencies where the winning margin was less than 5 percent, the Pakatan Rakyat led by Anwar Ibrahim are preparing a series of lawsuits to fight "overall fraud".
"Election petitions can only be filed after the results have been gazetted and we have 21 days to file after the gazette. We are preparing the evidence now because once it is gazetted, we have very little time," PKR vice president Tian Chua told a press conference on Wednesday.
"However we are not only filing because election petitions are very limited but we are also working with our lawyers and friends to file more general issues about bribery and constitutional matters that have been violated by the EC and caretaker government. So, it's not just limited to a few constituencies where we will file the election petitions, we will be challenging overall fraud by the caretaker government and the Election Commission."
His colleague, Fuziah Salleh who is the Kuantan MP, was also at the presser.
'Indelible' ink cornerstone that crumbled
The PKR leaders demanded that the Election Commission explain to the public why, despite its assurances to the contrary, the indelible ink applied to voters during the May 5 general election could disappear when the ink was supposed to stay on voters' index finger for a few days.
"I would again demand the EC chairman tells us what exactly is the content of the ink and I dare him to to repeat that it contains any trace of silver nitrate," said Tian, referring to the chemical which gave the ink its long-lasting quality.
Malaysia used indelible ink, meant to prevent cheaters from voting twice, for the first time during its recent 13th general election. As the indelible ink was to have been the cornerstone of the EC's promised reforms to clean up Malaysia's corrupt electoral system, its failure and the suspect quality of the ink has become the object of public ridicule.
The shock discovery has tarred the integrity of the polls, boosting the Opposition's claims of widespread electoral fraud and irregularities.
Till now there has been no response from either the EC or Prime Minister Najib Razak's Umno-BN government which claimed a 133-seats victory over the Pakatan Rakyat's 89 seats.
"The EC chairman has blatantly lied on the issues of indelible ink. He has not been consistent, he has insisted the indelible ink would be kept in a secret location and the color known only to 3 people. Now he says it is kept in police stations and if it is police stations, more than 3 people would know. So we want to know who are these 3 people," said Tian.
Tian, the MP for Batu, was referring to one of the issues in a long slew of complaints raised by polling agents, contestants and voters since the controversial election was balloted last Sunday.

STOLEN VICTORY: Pakatan to launch a slew of legal initiatives

THE outcome of the 13th General Election (GE13) has been widely known as covered extensively by both the electronic and print media. There would be many winners and many more losers, without taking into consideration the multitude of supporters on both sides, who would undoubtedly feel that they have won or lost.
ReplyDeleteLooking at it from a more philosophical angle, even the losers could be considered winners if they can sincerely appreciate the positive values of their opponents which have met the approval of the voters. In that way, they would have achieved additional views of their shortcomings, and thus could feel that they have "won" new knowledge that they have not seen before.
ReplyDeleteOn the other hand, the winners could be considered losers if they fail to see why a section of the electorate did not vote for them, no matter how small the number may be.
ReplyDeletePolitical parties, too, should take this same viewpoint and not just put the blame on the opposing political parties. They must strive to look deeper into their shortcomings, find ways to overcome them and not just put the blame on others.
ReplyDeleteIt would be prudent for both winners and losers to ponder deeply and try to share the thoughts of a well known philosopher, Beaumont, who stated: "We should correct our own faults by seeing how uncomely they appear in others".
ReplyDeleteIn this season where the exchange of congratulations is widespread, we should be thankful and congratulate ourselves for having a very democratic system embedded in the constitution of our country, which guarantees a system of checks and balances between the rulers, the government in power and the people.
ReplyDeleteThe mechanism that manages the election is appointed by the ruler and not the government in power, and as such, is unbiased and transparent in carrying out its task.
ReplyDeleteSpeaking about transparency, we should be glad that we have practised a system in elections that can be much more foolproof than even those practised by the so-called more democratic countries like the United States.
ReplyDeleteAs an example, we have a system whereby every voter is required to produce his or her MyKad to be counter-checked with the electoral register before he is given the ballot paper, ever since we started our first election.
ReplyDeleteIt is interesting to note that in the US, they are still debating on the necessity to produce IDs before they can cast their ballots. The state of Virginia had just approved a law on March 26 this year to make it compulsory for voters to produce an ID before getting a ballot paper, as reported in the Time magazine's April 13 issue.
ReplyDeleteWhile appreciating a good electoral system, we should also congratulate Election Commission chairman Tan Sri Abdul Aziz Mohd Yusof, a government pensioner, who with his team managed to do a splendid job for GE13, in the midst of uncalled-for criticisms.
ReplyDeleteLet us settle whatever differences we may have by referring to the appropriate authorities or to the established laws of the country and not take the law into our own hands.
ReplyDeleteIt is the adherence to this philosophy that has charted the successful cooperation with the legally elected state government of Selangor, which proved to be a successful and advantageous solution for both the state government and the Government Pensioners of Selangor since 2008.
ReplyDeleteNow that GE13 is over, which has left some negative side-effects, it becomes more important for the government pensioners, who represent the matured and knowledgeable section of our citizens, to take a leading role in forging better understanding between citizens who may harbour ideological differences in politics, ethnic origins and religious denominations, to set aside their differences and join hands in making Malaysia a better place to live in.

ReplyDeleteThe victory and increase in majority votes achieved by women who contested in the just concluded general election is a manifestation and testimony of the credibility and capacity of women in bringing about continuous change.
It also proved wrong any inclination among the public on women's inability in making a difference in the community.
Women candidate who won the state seat of Karambunai for three consecutive terms, Datuk Jainab Ahmad, expressed gratitude for the continuing confidence of the people in the Barisan Nasional (BN) leadership that led to her victory.
"It was not easy being a woman created to be a leader. However, the support and advice as well as guidance from the state leadership has enabled me to go through challenges...what is important is sincerity in the struggle, " said Jainab, who was one of 168 women candidates across the country contesting in the elections.
She described her victory in defending her Karambunai state seat despite facing four other candidates, aII men, as a victory for all women and a recognition of women's leadership in the country.
The increase in her majority votes achieved this time, compared to past elections, also further proved that women still get voter support Jainab obtained 74,074 votes with a majority of 8,532, a two-fold increase from her previous achievement.
"A win is considered as recognition of the ability of women to be part of the State leadership," she said.
Sabah BN fielded several women candidates to contest, including new faces in Tawau parliamentary seat and Luyang state seat, while Jainab in Karambunai and her Umno counterpart Azizah Dun contesting for the Beaufort parliamentary seat.
Azizah managed to wrest back Beaufort from incumbent Datuk Lajim Ukin who was formerly in BN before he quit and supported the opposition.
From the four seats contested by them under BN only one, Datuk Agnes Shim lost to Sabah DAP adviser Hiew King Cheu.
The contest for Tawau parliamentary seat saw BN newcomer Mary Yap Kain Ching regaining the seat previously held by the opposition by securing 21,337 votes, with a majority of 4,979.
Jainab said all women candidates who won their seats have been warned not to be complacent, and strive to continue the planning that is being implemented well for the people.
Azizah also expressed gratitude and thanks to the support provided which enables her to continue to serve.
"The victory proves people here believe in my ability and BN in implementing various development projects over the years," she said.
Yang akan mengendalikan PRU 13 tetap juga SPR, jadi ikut logik akal jika begitu buruk dan teruk kaedah pilihan raya yang dikendalikan SPR, apa gunanya lagi untuk PR berangan untuk menggapai kejayaan, bukan begitu?

ReplyDeleteHakikatnya PR sudah lama menerima hakikat bahawa SPR sememangnya telus, adil dan saksama sedari dulu lagi. Jika SPR benar-benar pincang, tiada seorang pun pemimpin PR yang akan bertanding dalam PRU 13 dan sebelumnya.
ReplyDeleteTentu ada agendanya maka sebab itu SPR sering dijadikan punching beg dan dijadikan sebagai kambing hitam oleh pemimpin pembangkang.
ReplyDeleteTak mustahil agenda PR dalam isu mempersoalkan kredibiliti SPR lebih kepada untuk menutup kelemahan sendiri kerana gagal menawan hati majoriti pengundi. Itu faktor utama yang tidak boleh disangkal sama sekali.
ReplyDeleteKemungkinan lain, ada kebarangkalian ianya untuk melindungi penipuan yang ingin dilakukan oleh PR misalnya melalui manipulasi dakwat kekal dengan mencalit dakwat itu kepada pengundi berusia konon untuk tujuan demonstrasi.

ReplyDeleteTimbalan Pengerusi Persatuan Bekas Tentera Malaysia, Kapten (B) Shahrudin Omar menyeru agar seluruh rakyat negara ini terutamanya pakatan pembangkang menghormati suara majoriti yang telah disuarakan oleh rakyat menerusi Pilihan Raya Umum (PRU) ke-13 yang lalu.
Tegas beliau, tindakan pembangkang yang mahu mengadakan perhimpunan di Stadium Kelana Jaya malam ini bagi menyelar Suruhanjaya Pilihan Raya (SPR) yang kononnya tidak telus dan penuh penipuan adalah lebih kepada memenuhi keperluan peribadi.
Jelasnya lagi, pilihan raya telah diadakan dan rakyat telah bersuara menentukan siapakah yang mereka mahu untuk mentadbir negara ini.
SPR pernah mengumumkan seramai 332 orang penolong pendaftar pemilih ditamatkan perkhidmatan kerana cuai atau sengaja mendaftarkan pengundi dengan maklumat yang meragukan.

ReplyDeleteOleh itu tambah beliau pembangkang perlu menerima suara majoriti sebagaimana Barisan Nasional (BN) menerima suara rakyat yang mahukan pembangkang mentadbir negeri Selangor, Kelantan dan Pulau Pinang.
“Sekiranya BN boleh menerima kekalahan dan suara rakyat untuk tiga negeri tersebut jadi mengapa pembangkang tidak boleh melakukan perkara yang sama. Ini sebenarnya adalah semata-mata mahu memenuhi kehendak peribadi Anwar Ibrahim. Kerana gagal menjadi Perdana Menteri, dia mula merangka agenda mengacau bilaukan negara.
“Tolonglah jadi rakyat negara ini yang bermaruah dan hormatkan perlembagaan negara. Sebagai seorang rakyat negara ini yang sayangkan negara, kita harus hormat perlembagaan dan peraturan yang telah ditetapkan. Jika kita sebagai rakyat negara ini sendiri tidak hormat dan tidak mengakui perlembagaan negara, jadi buat apa terus menetap dan menjadi warganegara Malaysia. Sebelumnya SPR pernah menolak permohonan seramai 71,184 pengundi yang didaftarkan oleh PPP kerana pelbagai kesalahan antaranya mendaftarkan pengundi yang telah berdaftar, warganegara yang belum layak mengundi, bukan warganegara dan pelbagai lagi kecuaian.

ReplyDeleteJelas beliau, SPR dijadikan ‘kambing hitam’ oleh pembangkang kerana mereka gagal menyerang dan menjatuhkan kerajaan.
“Oleh itu SPR dijadikan mangsa semata-mata untuk melepaskan geram kepada kerajaan. Saya menyeru kepada semua warganegara ini agar hargailah kestabilan, keharmonian dan kemakmuran negara yang sedia ada.
“Jangan terpengaruh dengan pembangkang yang mahu melihat negara ini kucar kacir. Belajar untuk menghormati suara majoriti yang disuarakan melalui demokrasi,” jelasnya lagi.
Anwar Ibrahim dilaporkan akan mengadakan perhimpunan malam ini di Stadium Kelana Jaya sebagai tanda memprotes pilihan raya yang didakwa tidak bersih da penuh penipuan.
Menariknya kebanyakan kesilapan daftar pengundi baru yang ditolak oleh SPR ini didaftarkan oleh wakil-wakil PR dan tak mustahil ada antara puluhan ribu permohonan pengundi baru yang didaftarkan oleh PR ini yang terlepas pandang oleh sistem semakan dan digunakan pula untuk memburukkan imej SPR.
ReplyDeleteDi lihat pada sejarah PR, beberapa perkara yang didedahkan di atas tak mustahil berlaku dan tidak salah untuk kita membuat spekulasi kemungkinan PR sedang merancang untuk menipu dalam pilihan raya.
ReplyDeleteTindakan mereka mengkambing hitamkan SPR sebelum ini hanyalah strategi serampang dua mata, pertama untuk membunuh imej dan kredibiliti SPR di mata umum dan kedua untuk melindungi penipuan yang sedang PR laksanakan.
ReplyDeleteSedangkan dalam pemilihan CEC DAP dan pengundian dalaman PKR sendiri wujud penyelewengan, dan PAS pula penah aktif memindah pengundi ke sana ke mari, jadi apa sangatlah untuk mereka merancang penipuan dalam PRU.
ReplyDeleteApa pun jika segala kemungkinan di atas tidak menepati senario sebenar, seeloknya PR hentikan sahaja propagandanya yang memperlekeh atau mempertikaikan kesungguhan SPR dalam melaksanakan tanggungjawabnya memastikan PRU 13 kelak berjalan lancar.

ReplyDeleteBeliau berkata pihak ini sengaja mencari kesalahan orang lain kerana enggan mengaku kekalahan, dan bagi mereka, pihak paling mudah untuk dijadikan ‘scape goat’ atau kambing hitam ialah SPR, dengan menimbulkan pelbagai persepsi bagi menjejaskan integriti, kredebiliti dan kecekapan badan itu.
ReplyDeleteBeliau memberi contoh tuduhan mengenai bekalan eletrik yang terputus semasa pengiraan undi dijalankan yang disebar banyak di laman-laman sosial, yang menurutnya selepas disiasat, perkara itu tidak pernah berlaku.

ReplyDeleteAbdul Aziz berkata persepsi merupakan mainan penting dalam politik, dan pihak yang kalah biasanya akan berusaha mencipta persepsi bahawa SPR ini satu badan yang tidak berwibawa, tidak berintegriti, sedangkan ia hanya bertanggungjawab menyediakan gelanggang, bukan menentukan siapa yang boleh menang atau kalah.
Beliau memberi contoh kenyataan seorang ahli politik yang secara terangan mendakwa kononnya SPR langsung tidak melaksanakan cadangan Jawatankuasa Pilihan Khas Parlimen Berhubung Dengan Penambahbaikan Proses Pilihan Raya, sedangkan menurutnya sebanyak 19 penambahbaikan diperkenalkan pada PRU13 berasaskan kepada cadangan jawatankuasa ini.
ReplyDeleteKatanya ia boleh dilihat dengan ketara seperti pengenalan dakwat kekal, tiada tempoh bantahan, calon tidak boleh berundur, undi awal, dan banyak lagi, namun persepsi SPR tidak membuat penambahbaikan tetap cuba dibangkitkan ahli politik itu semata-mata untuk menjejaskan integriti dan kredibilitinya.
Abdul Aziz berkata dakwat kekal diperkenalkan bagi mengelak pemilih mengundi lebih dari sekali, walaupun dalam sejarah negara ini tidak pernah dibuktikan ada orang yang mengundi lebih dari sekali, namun SPR tetap menerima cadangan penggunaan dakwat itu secara positif.
ReplyDeleteBagaimanapun menurutnya ada pihak sebaliknya sengaja cuba menjejaskan integriti SPR, berusaha sedaya upaya dengan pelbagai cara untuk menghilangkan kesan dakwat itu, semata-mata untuk menimbulkan keraguan orang ramai.
Namun menurutnya SPR tetap akan menerima segala teguran, mengkaji segala laporan daripada pelbagai pihak berhubung penggunaan dakwat kekal itu dan akan berusaha menambah baik aspek penggunaan dakwat kekal itu pada pilihan raya akan datang.
ReplyDeleteMerujuk kepada tohmahan mengenai kewujudan pengundi hantu, Abdul Aziz berkata beliau merasa kesal dengan tindakan sesetengah pihak yang terlalu bertindak mengikut emosi sehingga bukan sahaja menimbulkan kekecohan, malah beliau difahamkan ada juga pemilih yang dihalang dari menunaikan tanggungjawab mengundi, semata-mata kerana rupa parasnya tidak seperti rakyat tempatan.
Beliau berkata saringan utama paling penting dalam menentukan kesahihan pengundi adalah kad pengenalan, yang kemudiannya akan dibandingkan dengan daftar pemilih, dan hanya SPR dan polis sahaja yang berhak menahan seseorang untuk memeriksa kad pengenalannya.

Honestly, I am with the Rakyat, fed-up with the childish antics of the sore losers. I don't really care how the new IGP plans to do it, but make sure you protect our interest - the interest of the Rakyat, who are your boss, and stop any attempt by the Pakatan folks to overthrow the Government other than via the ballot box.

ReplyDeletePETALING JAYA: TUNKU Abdul Aziz Tunku Ibrahim came out with guns blazing yesterday and labelled opposition lawmakers as "anarchists" for propagating illegal activities by staging illegal rallies to topple the government.
The former DAP vice-chairman, who is now a harsh critic of the opposition pact, was in a fiery mood when he said opposition leaders had always been belligerent about toppling the government, which was contradictory to their stature as lawmakers.
From spouting ludicrous accusations to holding rallies that threatened public order, Tunku Aziz said such a trait was highly evident during Bersih demonstrations.
ReplyDeleteOn Pakatan's protests against the general election results, Tunku Aziz said: "The fact that (Datuk Seri) Anwar (Ibrahim) did not make it to Putrajaya, he (and his supporters) should leave other Malaysians in peace.

On the safety of people and how the matter could be resolved, Tunku Aziz said the government was aware of the issue and steps were being taken to contain the possible formation of rallies.
